This Service Agreement ("Agreement") constitutes a binding contract between BaygenX ("BaygenX," "Company," "We," or "Us") and you ("User" or "you") concerning your utilization of BaygenX's mobile gaming platforms (including Blackjack : Fantasy AI Dealers, BalPoker, Multi Level Poker, and Repair Rush Arrows) and associated services (the "Platform"). Accessing or utilizing any BaygenX Platform indicates that you have reviewed, comprehended, accepted, and consent to be governed by this Agreement.
Blackjack : Fantasy AI Dealers, BalPoker, Multi Level Poker, and Repair Rush Arrows target users aged 18 and above for recreational purposes exclusively and do not provide "actual money gambling" or chances to earn real currency through gaming. Participating in these games does not guarantee future success in "real money gaming."
This Agreement encompasses the conditions outlined on this page, plus terms from the following supplementary policies incorporated by reference:
BaygenX maintains the authority to alter, modify, supplement, or remove sections of this Service Agreement at any time by publishing updated terms on or within the Platform. You are responsible for regularly reviewing these terms. Continued Platform usage following term modifications constitutes acceptance of the revised Agreement.
When changes significantly impact your rights or obligations, BaygenX will notify you through methods such as email to your registered address or notifications during your next Platform login.
Accessing or using the Platform, including browsing BaygenX websites or accessing our games (including Blackjack : Fantasy AI Dealers, BalPoker, Multi Level Poker, and Repair Rush Arrows), signifies acceptance of these terms. You confirm that you are at least eighteen (18) years old, have not been previously suspended or banned from the Platform, and are not restricted from receiving U.S.-origin products.
You must be at least 18 years old to establish an account or use the Platform. Users under 18 are prohibited from Platform usage under any circumstances.
Creating or updating a Platform Account may require providing BaygenX with personal information, potentially including your name, birth date, email address, and sometimes payment details. You agree to provide accurate and complete information to BaygenX and promptly update information when it changes.
You bear sole responsibility for maintaining your Login Information confidentiality and will be accountable for all Login Information uses, including purchases, regardless of authorization. You are responsible for all activities occurring through your Account, whether or not you performed such actions.
You agree to the following Platform usage requirements:
The Platform may offer opportunities to obtain, accumulate, manage, and purchase virtual, in-game currency and other digital assets ("Virtual Assets") that may require real money payment. Virtual Assets possess no monetary value and cannot be transferred or redeemed for real money, goods, or any monetarily valuable items.
Virtual Asset purchases are final and non-refundable, non-transferable, and non-exchangeable, except at BaygenX's sole discretion. BaygenX reserves the right to manage, control, modify, and/or eliminate Virtual Assets at its sole discretion.
You agree that your Platform usage will be lawful and compliant with usage rules. You agree not to:
BaygenX retains all rights in Platform materials, including applications, software, designs, graphics, texts, information, pictures, video, sound, music, and other files. The entire Platform contents are protected by applicable copyright, trademark, and other intellectual property laws.
You shall not modify, decompile, disassemble, reverse engineer, copy, transfer, create derivative works from, or distribute any Platform Materials without BaygenX's explicit, prior written permission.
BaygenX may deny Platform access or terminate your account without notice for any reason, including suspected Agreement violations. Account termination may result in loss of username and game progress.
Upon account termination, no refunds will be provided, no Virtual Assets will be credited or converted to cash, and you will lose access to your account.
YOU ACKNOWLEDGE THAT YOUR PLATFORM USAGE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAYGENX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM AND YOUR USAGE THEREOF.
BaygenX makes no warranties or representations regarding Platform content accuracy or completeness and assumes no liability for content errors, mistakes, or inaccuracies.
BAYGENX SHALL NOT BE LIABLE TO YOU FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA ARISING FROM YOUR PLATFORM USAGE.
You agree to indemnify and hold BaygenX harmless from any loss, liability, claim, demand, damages, costs, and expenses, including reasonable attorney's fees, arising from your Platform usage or Agreement violations.
Disputes arising from this Agreement shall be resolved through binding arbitration. Arbitration employs a neutral arbitrator instead of a judge or jury and has very limited court review.
You understand and agree that by entering this Agreement, you and BaygenX waive the right to jury trial or class action participation.
Any arbitration will follow the American Arbitration Association's ("AAA") Commercial Dispute Resolution Procedures and be administered by the AAA. Parties seeking arbitration must first send written dispute notice to the other party.
This Agreement shall be governed by [Your State] laws without regard to conflict of law provisions. Any permitted legal action must be resolved exclusively by state or federal courts located in [Your County], [Your State].
This Agreement constitutes the complete agreement between you and BaygenX regarding the Platform. If any provision is found unenforceable, remaining provisions shall remain in full force and effect.
